These Terms and Conditions, together with any other additional conditions that may be established, expressly regulate the relation arising between “EPOCA Home Interiors SL” (hereinafter “EPOCA”) and a third party (hereinafter, the “User” or the “Buyer”) who navigates the Internet website www.epocahome.com (hereinafter the” Website”) and places an order by any of the means made available by EPOCA (website, email, phone, text message, fax…).
By navigating the website or ordering any of our goods the user agrees to be bound by these terms and conditions.
All purchase orders received by EPOCA and confirmed by the client by the issuing of a confirmation down-payment are governed by these Terms and Conditions whether the order was made through EPOCA’s website or off line using other communication means such as a email, fax or message.
This website is property of EPOCA Home Interiors S.L., Spanish commercial entity with fiscal address in Calle Canillas 1, 28002 Madrid (Spain) and Tax Identification Code number B87302311 and registered in the Madrid Mercantile Register, volume 3358, folio 29, section 8, page M-604435, entry 1.
EPOCA SL reserves the right to unilaterally change without notice, and at any time the presentation and configuration of Website. EPOCA may also at any time and without notice, amend these terms and conditions by posting such changes on the Website in order to make them known to Users before the purchase of any goods offered in the Website.
Product Information – EPOCA will display full details on the specific product name, reference, size, format, price and availability / delivery.
Purchase Procedure – 1. Online: Filling in the form established for this purpose in the Web site; 2. By phone: By calling Customer Service +34 923 243 521 on regular business hours, Monday to Friday from 8.00am to 06.00pm (CET). 3. By email at info@epocahome.com.
Registered Users – The User is given the option to enrol as a Registered User in the Website. Once the registration form is filled in, the User will access the Website by use of a username and password, which will automatically retrieve the User’s billing and shipping details. The username and password are personal and not transferable. EPOCA may make, with proper notice, changes in the username and / or password. Registration is only available for users at least eighteen (18) years old and with the legal minimum age for contracting the services offered in EPOCA according to the laws of their country of residence.
Price – At the time of the purchase price will be displayed by product, including VAT. Purchases made by natural or legal persons resident in any member country of the European Union are subject to the payment of Value Added Tax (VAT). Purchases made by resident individuals or legal persons not members of the European Union countries are exempt from VAT. For more information on import taxes in countries not members of the European Union please see section “Shipping”.
Minimum Order – The minimum order will vary depending on the product and appear specified in the particular product.
Geographical Coverage – EPOCA sells in all countries of the European Union and some countries outside EU specified on the Website.
Shipping – EPOCA collaborates with various transport companies. Please see Shipping Policy information for more details. EPOCA may on occasions offer users the possibility of contracting an express service to reduce delivery times. The cost of an express delivery will be entirely covered by the User.
Confirmation of an Order – Upon receipt of the purchase order and verification of payment, EPOCA will send the User a delivery note via e-mail confirming the purchase. In addition, with delivering of the product EPOCA will provide the User with a copy of these General Terms and Conditions, which the User had already expressly accepted by when the purchase was made on the Website. All orders are subject to acceptance by EPOCA and the availability of the requested item(s). If your order has been unsuccessful, you will be made aware of the reason why and possible explanations.
Payment – Users can pay for their purchases with:
- Credit Card (VISA, MasterCard, American Express);
- Debit card;
- PayPal;
- Bank transfer to the account EPOCA has opened in Banco Sabadell. EPOCA´s VAT Nr. is B86666112 and the post address is c/ Doctor Torres Villarroel 9, Oficina 1, Salamanca, Spain.
Other methods of payment are not accepted. The amount of the purchase order plus the shipping costs will be charged at the time the order is placed.
Trade Clients – Interior design studios, architects, purchase companies, prescriptors and any other company or individual in the sector of interior design may be granted the condition of Trade Client. Trade Clients benefit from special promotions and discounts in percentages or fixed amounts to be decided by EPOCA’s sole discretion.
Order Delivery – Deliveries will be made Monday through Friday. EPOCA undertakes to deliver the product purchased at the address the User provided for this purpose on the order form. Deliveries to PO Boxes are not accepted. EPOCA has delivery agreements with different transport companies. Shipping costs both in standard mode and express mode are reflected in the Web page. EPOCA will ship and deliver goods only when full payment of the order has been satisfied. EPOCA reserves the right to charge a 2% weekly storage fees if client fails to satisfy balance payments whithin a maximum of seven (7) days since the order is finished and ready for shipping.
Promotions – EPOCA can sometimes offer promotions, offers or discounts on some or all of their products. Unless expressly stated otherwise, the use of a promotional offer or discount cannot be combined with other promotions, offers or discounts. Each promotional code is strictly limited to one use per customer, it cannot be passed to anyone else and must always be kept confidential. Promotional codes cannot be exchanged for cash. EPOCA retains the right to unilaterally cancel or withdraw a specific promotional code if used by the user in a different way in which the code was issued.
Incidents Return of Wrong or Defective Products –
Since all EPOCA products are custom made according to the exact specifications of format, size and frame decided by each User, there is no possibility of returning the products purchased beyond those cases in which EPOCA delivered wrong or defective goods for reasons attributable to EPOCA (Art. 103.C of the Spanish General Law for the Defence of Consumers and Users). For cases in which EPOCA delivered wrong or defective goods for reasons attributable to EPOCA, the client must report such defects or wrong items no later than 14 days since delivery of the order. No claim will be accepted after 14 days since delivery of an order.
For a return (only for cases reported within 14 days since delivery of an order) to be accepted the item returned must be in perfect condition and in its original packaging. No return will be accepted if not returned in the original packaging. The carrier may refuse a collection if these requirements are not met. Under all circumstances the Buyer is responsible for arranging and satisfying all cost related to the return. Once the item is received by EPOCA in perfect condition and the reason for the return is positively verified, EPOCA may choose to proceed to the reparation or substitution of the returned pieces. The Buyer is responsible for arranging and satisfying all cost related to the shipment of the goods once repared or substituted. EPOCA does not issue refunds.
If, at the moment of delivery, the Buyer appreciates damages in the packaging, the Buyer may refuse the package by: 1. communicating directly to the delivery company driver that the shipment is rejected; 2. accepting it but indicating the defect in the delivery order and immediately contacting EPOCA via email info@epocahome.com within 24 hours since reception of the order. For any claim to be accepted, the Buyer must provide EPOCA with photographic evidence and copy of the delivery order indicating that the package showed damages at the time of delivery. In this case EPOCA will bear the cost of return.
The Buyer understands that the products purchased through EPOCA are the result of a handmade and non-mechanized work, and that as a result of the manufacturing process the final product may contain little variations from the image posted on EPOCA’s website. The variations do not alter the main product’s features nor they decrease the value of the product. Such variations may not constitute cause for return or exchange beyond the limits set by the General Law for the Protection of Consumers and Users of 27 March 2014.
The Buyer agrees that the colours of the products presented in the website may vary depending on the screen in which they are seen. Similarly, the Buyer understands that the final product may have slight differences in shades of colours and intensities between what is shown on a digital display and the final product. Such variations may not constitute cause for return or exchange beyond the limits set by the General Law for the Protection of Consumers and Users, to March 27, 2014.
Claims – EPOCA has complaint forms available to any user, at the registered office of EPOCA located in c/ Marcenado 1, 28002 Madrid.
User Obligations – The User agrees to comply with these General Terms and Conditions, as well as to meet the special warnings or instructions contained therein or on the Website and to always act according to law, good morality and the requirements of good faith, using the diligence appropriate to the nature of service enjoyed by refraining from using the Website in any way that may impede, damage or impair the normal functioning, property or rights of EPOCA, its suppliers, other users or in general any third party.
Specifically, and without implying any restriction to the obligation assumed by the user in general accordance with the previous paragraph, the User agrees
- To when registering, to provide truthful data and to keep it updated.
- To not enter, store or distribute in or from the Website any information or material that is defamatory, libellous, obscene, threatening, racist, incites violence or discrimination based on race, sex, ideology, religion or in any form threatens the way, public order, fundamental rights, public freedoms, honour, privacy or the image of others and general regulations.
- To not enter, store or disseminate through the Website any computer program, data, virus, code, hardware or telecommunications equipment or any other instrument or electronic or physical device that is capable of causing damage to the Website, any Services or in any of the equipment, systems or networks of EPOCA, any User of the Website, EPOCA providers or in general any third party, or otherwise be able to cause any disruption or impede the normal functioning of the same.
- To properly safeguard the username and password, as identifiers and keys for access to the purchase of products, agreeing not to transfer their use or to allow access to them by third parties, assuming responsibility for damages could result from improper use of them. Likewise, the User undertakes to immediately inform EPOCA about their loss or theft as well as about any risk of access to the username and / or password by a third party.
- To not make advertising, promotional or commercial exploitation activities through the Website, not using the contents and in particular the information obtained through the Website to send advertising messages for direct marketing purposes or any other commercial purpose or to collect or store personal data of third parties.
- To not use false identities or impersonate others in the use of the Website or in the use or purchase of any Products, including the use of passwords or access codes of third parties or otherwise.
- To not destroy, alter, disable or damage data, information, programs or electronic documents EPOCA, its suppliers or third parties.
- To not enter, store or transmit through the Website any content that infringes intellectual property rights, industrial or business secrets of third parties, or in general any content that does not hold, in accordance with the law, the right to make it available to third.
Safety – EPOCA guarantees the security and confidentiality of payment by debit or credit cards and their data using a secure server SSL, which activates when their personal data is entered. This server ensures that your data is encrypted to the service centre and so reading and manipulation by third parties are avoided.
Intellectual Property Rights – EPOCA owns or is the licensee of all intellectual property rights in the Website and the material displayed on the Website (including logos, texts, images, data, graphics, layout, films, audio material, algorithms, item details and/or software) as well as the trademarks displayed on the Website.
EPOCA grants the User a limited, temporary, revocable, and non-exclusive licence to access, browse and use the Website.
Absolutely no element of the Website may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in full or in part, for any purpose without EPOCA’s prior written consent. In particular, the User is not allowed to republish any part of the Website on another website, in any other medium (print, electronic or otherwise) or as part of any commercial service without EPOCA’s prior written permission. All the intellectual property rights referred to above remain owned by EPOCA or our relevant licensor.
Disclaimers and Limitations of Liability – EPOCA reserves, without notice at any time, the right to temporarily suspend access to the Website and to make changes it deems appropriate in it. EPOCA is not responsible for the information, services and / or products offered and / or provided by third parties through the Website or content provided by third parties. EPOCA is not responsible for any damages to the software or hardware of the user arising from access to the Website or use of information or applications contained within it.
